Terms of Service

These Terms of Service (“Terms”) govern your use of the Escalated website at escalated.dev, the Escalated open-source software, and any hosted service we make available under the “Escalated Cloud” brand (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Open-source software
Escalated’s source code is published on GitHub under the MIT License. The MIT License governs your rights to copy, modify, and redistribute the source code and your own self-hosted installations. These Terms apply to your use of the website and hosted services we operate directly; they do not modify, limit, or replace the MIT License as it applies to the source code itself.
2. The Service
Escalated provides:
- escalated.dev — a marketing, documentation, and community site;
- Open-source software — the Escalated core package and framework integrations, distributed under the MIT License; and
- Escalated Cloud — an optional hosted version of Escalated. Cloud is subject to additional terms presented at sign-up; those terms prevail over these general Terms where they conflict.
3. Eligibility and accounts
You must be at least the age of majority in your jurisdiction to create an account. You are responsible for keeping your credentials confidential and for activity that takes place under your account. Notify us promptly if you suspect any unauthorized access.
4. Acceptable use
You agree not to:
- use the Service to violate any law or infringe anyone’s rights;
- upload malware or otherwise attempt to damage or disrupt the Service;
- attempt to gain unauthorized access to the Service, other accounts, or related infrastructure;
- send spam or unsolicited communications through the Service, or use it to harass others; or
- scrape or extract data from the Service in a manner that exceeds ordinary, documented API usage or that violates applicable rate limits.
5. Your content
You retain ownership of the content you submit to the Service (for example, support tickets you create through Escalated Cloud or issues you file on GitHub). You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, and display that content solely to operate the Service for you and the people you share it with. Community contributions to the open-source project are governed by the licensing and contribution terms in the applicable repository.
6. Third-party services
The Service may link to or integrate with third-party products (for example, GitHub, newsletter providers, or analytics services). We are not responsible for those third parties, and your use of them is governed by their own terms and privacy policies.
7. Fees
escalated.dev and the Escalated open-source software are free to use. Escalated Cloud may involve fees; those fees, payment terms, and refund policies will be presented to you before you subscribe and will form part of your agreement with us for Cloud.
8. Disclaimer of warranties
THE SERVICE AND THE OPEN-SOURCE SOFTWARE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ESCALATED OR ITS CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD $100.
10. Indemnification
You agree to defend, indemnify, and hold harmless Escalated and its contributors from any claim, damages, liabilities, and expenses (including reasonable attorney’s fees) arising out of or related to your use of the Service or your violation of these Terms.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you materially violate these Terms or if we are required to do so by law. Sections that by their nature should survive termination will survive.
12. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
13. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
